Terms of Service

1. Agreement to terms
By accessing or using the YourCare platform (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
The Service is operated by YourCare Health Pty Ltd (ABN pending), an Australian company (“YourCare”, “we”, “us”, “our”).
2. Description of the Service
YourCare is a mutual aid platform that enables communities to organise care through private messaging, mutual aid pools, a transparent ledger, and a care services directory. The platform is designed to facilitate direct financial transactions between community members.
YourCare is not a financial institution, bank, insurer, or healthcare provider. We do not provide financial advice, medical advice, or any regulated financial services.
3. Eligibility
You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate and complete.
4. Your account
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately if you suspect unauthorised access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Harass, abuse, threaten, or intimidate other users.
- Post fraudulent listings or create deceptive mutual aid requests.
- Engage in money laundering, fraud, or other financial crimes.
- Distribute malware, spam, or other harmful content.
- Attempt to gain unauthorised access to the Service or other users’ accounts.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service for any illegal or unauthorised purpose.
6. Communities and mutual aid
- Communities are self-governing groups. Community administrators set their own rules and manage membership, pools, and disbursements.
- Mutual aid pools are voluntary. Contributions are made at each member’s discretion. YourCare does not guarantee that any pool will reach its funding target.
- Pool administrators are responsible for approving disbursements and managing community funds in accordance with their community’s expectations.
- YourCare does not hold, control, or custody member funds at any point. Funds flow directly between members via our payment processor.
- All contributions and disbursements are recorded on a transparent, append-only ledger visible to community members.
7. Payments
- Payments are processed by Stripe. By making or receiving payments through the Service, you also agree to Stripe’s terms of service.
- YourCare facilitates transactions between members but is not a party to those transactions.
- Refunds for mutual aid contributions are managed by community administrators through the platform. YourCare does not independently process refunds.
- You are responsible for any taxes or reporting obligations arising from payments you receive through the Service.
8. Care directory
- The Care directory allows members to post offers and needs. Listings are user-generated content and YourCare does not endorse, verify, or guarantee any listing.
- Transactions arising from Care listings are between the members involved. YourCare is not responsible for the quality, safety, or legality of any goods or services listed.
- You are responsible for ensuring that your listings comply with applicable laws and regulations.
9. Content and intellectual property
- You retain ownership of content you create on the platform (messages, listings, profile information).
- By posting content, you grant YourCare a limited licence to store, transmit, and display that content as necessary to operate the Service.
- The YourCare name, logo, and platform design are the property of YourCare Health Pty Ltd.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant that any information provided through the Service is accurate or complete.
12. Limitation of liability
To the maximum extent permitted by law, YourCare Health Pty Ltd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid to YourCare (if any) in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless YourCare Health Pty Ltd from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
14. Termination
- You may delete your account at any time. Upon deletion, your personal information will be removed in accordance with our Privacy Policy.
- We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your conduct poses a risk to other users or the platform.
- Sections of these Terms that by their nature should survive termination will survive, including disclaimers, limitations of liability, and indemnification.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales.
