The Office of Public Guardian acts as a substitute decision maker for a person with a disability and incapacity to make their own decisions. The Public Guardian is appointed by NSW Guardianship Tribunal. The Public Guardian makes decisions in areas such as Accomodation services and consenting to medical and dental treatment. The Public Guardian also advocates for the services and support needed by people under guardianship. The aim is to support the rights of adults with disabilities to make their own life decisions wherever possible.

The Office of the Public Guardian is a substitute decision maker, not a substitute caregiver or case manager. It may make decisions on behalf of the person in areas such as accommodation, medical treatment, dental treatment or other services. The Public Guardian is the guardian for the length of time specified in the order made by the Guardianship Tribunal. At the end of this time a review will be held by the Guardianship Tribunal to decide whether a guardian is still needed. The Office of the Public Guardian will send information about organising Enduring Guardianship.

Guardianship Tribunal is a legal tribunal that appoints guardians and financial managers for adults with disabilities who are incapable of making their own decisions. The guardianship tribunal will consider appointing a family member or friend. If this is not appropriate the tribunal will appoint the Public Guardian, or the protective commissioner.
